Terms of service
HERBELIA Terms of Use and Conditions of Sale
IMPORTANT – PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS OF SALE (“TERMS” OR “AGREEMENT”) BEFORE ACCESSING, USING, OR PLACING AN ORDER THROUGH OUR WEBSITE. THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY (SEE SECTIONS 13 AND 14). THESE TERMS FORM AN ESSENTIAL BASIS OF OUR AGREEMENT. PLEASE PRINT AND KEEP A COPY OF THIS AGREEMENT FOR YOUR RECORDS.
Your use of herbelia.co, including any sub-domains, affiliated websites, and mobile applications (collectively, the “Website”), which are owned and maintained by HERBELIA (“we,” “our,” “us”), is governed by the policies, terms, and conditions below. We offer the Website, including all information, tools, products, and services available through it, to you, the user, on the condition that you accept all terms, conditions, policies, and notices stated here. By accessing, using, or placing an order through the Website, you agree to these Terms. If you do not agree to them in their entirety, you are not authorized to use the Website in any manner.
THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, A JURY TRIAL, AND PARTICIPATION IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED IN SECTION 15 OR IF YOU OPT OUT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 15, WHICH DESCRIBE YOUR RIGHT TO OPT OUT.
You can review the most current version of these Terms at any time at herbelia.co/policies/terms-of-service. We reserve the right to update, change, or replace any part of these Terms by posting updates to the Website. It is your responsibility to check this page periodically. YOUR CONTINUED USE OF OR ACCESS TO THE WEBSITE AFTER ANY CHANGES ARE POSTED CONSTITUTES BINDING ACCEPTANCE OF THOSE CHANGES.
1. Website Use
By using the Website and agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. By using the Website, you affirm that you have the legal capacity to enter into a binding contract with us, have read this Agreement, and understand and agree to its terms.
2. Privacy & Security Disclosure
Our Privacy Policy is available at herbelia.co/policies/privacy-policy. It is incorporated into these Terms by reference and forms part of these Terms.
3. General Conditions and User Conduct Restrictions
All aspects of the Website are protected by U.S. and international copyright, trademark, and other intellectual property laws. You do not acquire any ownership or other rights by downloading or using the Website or any material on it.
You agree not to use or attempt to use the Website or any products or services for any unlawful purpose or in any unlawful manner, including but not limited to: (1) hacking or other digital or physical attacks on the Website; (2) publishing abusive, vulgar, obscene, or defamatory material; (3) soliciting others to perform or participate in unlawful acts; (4) violating any international, federal, provincial, or state regulation, rule, law, or local ordinance; (5) infringing our intellectual property rights or those of others; (6) harassing, abusing, insulting, harming, defaming, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (7) submitting false or misleading information; (8) uploading or transmitting viruses or other malicious code that may affect the functionality or operation of the Website; (9) collecting or tracking the personal information of others; (10) interfering with or circumventing the Website’s security features; or (11) any other unlawful act.
HERBELIA reserves the right to terminate your access to the Website or any of its services if we determine that you (1) have not complied with these Terms; (2) provided false, inaccurate, or incomplete information; (3) engaged in conduct that harms HERBELIA’s rights or interests in its Website, services, or other property; or (4) for any or no reason, without prior notice. HERBELIA may take any other action necessary in this regard or seek any remedy permitted by law.
4. Products Sold for Personal Use Only
You agree that any products or services you purchase from HERBELIA through the Website are for your personal, non-commercial use. You agree not to resell, redistribute, modify, or export any product ordered from the Website. Resale outside authorized channels can result in products that are materially different — for example, improperly stored or unsealed botanicals — which may affect quality, safety, or our ability to honor guarantees. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
5. No Medical Advice; Accuracy, Completeness, and Timeliness of Information
The material on the Website is provided for general informational purposes only and is not intended as medical advice or as a substitute for advice from a qualified healthcare provider. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. You should consult your healthcare provider before using any information or product provided by HERBELIA, particularly if you are pregnant, nursing, taking medication, or managing a medical condition.
While we aim to provide accurate and current information, the Website may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
We make every effort to display the colors and images of our products as accurately as possible. Because our blend is made from whole, natural botanicals, the color, texture, and appearance of each batch may vary slightly. We also cannot guarantee that your device’s display of any color will be accurate.
The Website may contain historical information, which is not necessarily current and is provided for reference only. We reserve the right to modify the contents of the Website at any time but have no obligation to update any information. You agree that it is your responsibility to monitor changes to the Website.
HERBELIA does not guarantee that you will achieve any particular health or wellness goal. Individual results vary depending on factors unique to you, such as age, health, lifestyle, and genetics.
6. Modifications to the Website and Prices
We reserve the right to modify or discontinue the Website (or any part or content of it) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Website. Certain products may be available exclusively online through the Website, may be available in limited quantities, and are subject to refund, return, or exchange only according to our Shipping Policy and Returns & Refunds Policy.
All product descriptions and pricing are subject to change at any time without notice, at our sole discretion. Any offer for any product or service made on the Website is void where prohibited.
7. Payment
By submitting payment information, you represent and agree that: (i) you are fully authorized to use that card or account; (ii) all payment information provided is complete and accurate; (iii) you are responsible for any payment card fees; and (iv) sufficient funds exist to pay the amount(s) due.
We and our third-party payment service providers may request, and may receive, updated card information from your card issuer, such as a new card number or expiration date when your card has expired. If we receive updated information, we will update your account accordingly. Your card issuer may allow you to opt out of sharing updated card information with vendors and payment processors; to do so, contact your card issuer.
We are not responsible for any fees or charges your bank or card issuer may apply. If your bank or card issuer reverses a charge, we may bill you directly and seek payment by another method, including a mailed statement.
8. Order Placement and Acceptance; Subscriptions, Automatic Payment, and Cancellation
Order Placement and Acceptance. Your electronic order confirmation, or any other form of confirmation, does not signify our acceptance of your order. We reserve the right to accept or decline shipment to anyone for any reason. If we decline your order, you will receive a refund to your original form of payment. You agree that we are not liable for any losses or damages resulting from our refusal to provide any product or service. We reserve the right to require additional information before processing any order.
Subscriptions, Automatic Payment, and Cancellation. When purchasing a product on the Website, you may have the option of a one-time purchase or enrolling in HERBELIA’s subscription plan. If you enroll, your subscription is automatically billed every thirty (30) days to the payment method you provided and shipped to you until you cancel. You may request a different delivery frequency (for example, every 45, 60, or 90 days) by contacting our support team at support@herbelia.co. We may use an account updater to automatically update your card information if it changes, in which case your renewal will be billed to the updated account.
You may cancel your subscription at any time; however, you must cancel at least twenty-four (24) hours before your next shipment is processed to avoid receiving and being charged for that order. To cancel, use the customer portal on herbelia.co or email support@herbelia.co.
IF YOU ENROLL IN THE HERBELIA SUBSCRIPTION PROGRAM AT THE TIME OF YOUR INITIAL PURCHASE AND PROVIDE A VALID CREDIT CARD NUMBER OR ALTERNATE PAYMENT METHOD, EACH PAYMENT WILL BE PROCESSED AUTOMATICALLY AT THE TIME OF EACH SHIPMENT AND BILLED TO THE PAYMENT METHOD YOU PROVIDED AT ENROLLMENT. YOU MAY CANCEL YOUR PARTICIPATION IN THE HERBELIA SUBSCRIPTION PROGRAM AT ANY TIME BY EMAILING SUPPORT@HERBELIA.CO OR THROUGH THE CUSTOMER PORTAL.
If your payment method fails to process for a subsequent shipment, you agree that HERBELIA may contact you at any phone number (including a mobile number) or email address you provided to request alternate payment information. If you fail to pay for any product or service received, your account may be sent to collections.
9. Shipping
HERBELIA ships primarily to addresses in the United States, with international shipping available to select countries. Please see our Shipping Policy for details on order processing, handling, shipping times, and carriers. You can also track your order through the link in your shipping confirmation email.
An accurate shipping address and phone number are required. We are not responsible for late or missing shipments caused by incorrect shipping information. If you discover a mistake in your order after submitting it, or wish to cancel before it ships, contact support@herbelia.co as soon as possible. We cannot guarantee that we will be able to modify or cancel your order.
10. Delivery Confirmation
Because many circumstances at your delivery address are beyond our control, you agree that delivery confirmation provided by the carrier is sufficient proof of delivery to the cardholder, even without a signature.
11. Money-Back Guarantee
HERBELIA offers a 30-day Money-Back Guarantee on your first order of each product, valid for 30 days from the delivery date. No return of the product is required. The guarantee applies only to products purchased directly from herbelia.co. If you claim a refund under this guarantee and later repurchase the same product, the guarantee will not apply to the repeat purchase. To request a refund, email support@herbelia.co.
For all approved refunds, HERBELIA will refund the full purchase price to the original payment method used for the order. Full eligibility conditions, exceptions, and processing timelines are set out in our Returns & Refunds Policy, which is incorporated into these Terms by reference.
12. Social Media
This section applies to everyone who interacts with our social media presence, including comment sections, feeds, and other content on Facebook, Instagram, TikTok, YouTube, Pinterest, X, or any other third-party social media platform we use (“Social Media Presence”).
The platforms hosting our Social Media Presence are not controlled by us and have their own privacy policies and terms of use. Comments and opinions expressed by users are their own and do not reflect the views of HERBELIA, and we have no obligation to monitor or remove user comments. If you see an offensive or inappropriate post or comment, please report it to the platform operator using its reporting procedures.
13. Disclaimer of Warranties
EXCEPT WHERE PROHIBITED BY LAW, THE WEBSITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO, AND EXPRESSLY DISCLAIM ANY, REPRESENTATIONS AND WARRANTIES AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY, OR COMPLETENESS OF ANY INFORMATION ON THE WEBSITE. WE DO NOT REPRESENT OR WARRANT, AND EXPRESSLY DISCLAIM, THAT: (A) OUR PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE WEBSITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR (B) THE WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ALL CONDITIONS, REPRESENTATIONS, AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
14. Limitation of Liability
EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT SHALL HERBELIA OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES, FEES, COSTS, OR CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT, THE PRIVACY POLICY, THE PRODUCTS, OR YOUR OR A THIRD PARTY’S USE OR ATTEMPTED USE OF THE WEBSITE OR ANY PRODUCT, REGARDLESS OF WHETHER HERBELIA HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES, FEES, COSTS, OR CLAIMS. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, AND THE COST OF PROCURING SUBSTITUTE PRODUCTS OR SERVICES. THIS APPLIES REGARDLESS OF HOW THE DAMAGES ARE ALLEGEDLY CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR OTHERWISE. IF, NOTWITHSTANDING THESE LIMITATIONS, HERBELIA IS FOUND LIABLE UNDER ANY THEORY, HERBELIA’S LIABILITY AND YOUR EXCLUSIVE REMEDY WILL BE LIMITED TO USD $500.00. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
15. Dispute Resolution by Mandatory Binding Arbitration and Class Action Waiver
PLEASE READ THIS PROVISION CAREFULLY. IT REQUIRES YOU TO ARBITRATE ANY DISPUTE OR CLAIM BETWEEN YOU AND HERBELIA ON AN INDIVIDUAL BASIS.
YOU AGREE THAT ANY DISPUTE OR CLAIM ARISING FROM OR RELATING TO THIS ARBITRATION PROVISION, HERBELIA’S PRIVACY POLICY OR TERMS OF SALE, HERBELIA’S ADVERTISING OR MARKETING PRACTICES, OR HERBELIA’S PRODUCTS OR SERVICES SHALL BE SUBMITTED TO BINDING, FINAL, AND CONFIDENTIAL ARBITRATION BEFORE A SINGLE ARBITRATOR ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) UNDER ITS CONSUMER ARBITRATION RULES. THIS PROVISION IS GOVERNED BY THE FEDERAL ARBITRATION ACT (“FAA”), 9 U.S.C. §§ 1–16, AND THE ARBITRATOR SHALL BE BOUND BY ITS TERMS. THE ARBITRATOR SHALL HAVE EXCLUSIVE AUTHORITY TO DETERMINE WHETHER A DISPUTE OR CLAIM IS ARBITRABLE. THE ARBITRATOR SHALL APPLY THE SUBSTANTIVE LAW OF THE STATE OF WYOMING TO THE EXTENT CONSISTENT WITH THE FAA, AND MAY AWARD ALL REMEDIES AVAILABLE IN AN INDIVIDUAL LAWSUIT UNDER SUBSTANTIVE LAW, INCLUDING COMPENSATORY, STATUTORY, AND PUNITIVE DAMAGES; DECLARATORY, INJUNCTIVE, AND OTHER EQUITABLE RELIEF, INCLUDING PUBLIC INJUNCTIVE RELIEF; AND ATTORNEYS’ FEES AND COSTS WHERE AVAILABLE. THE ARBITRATOR MAY ONLY RESOLVE DISPUTES BETWEEN YOU AND HERBELIA AND MAY NOT CONSOLIDATE CLAIMS OR PROCEEDINGS WITHOUT HERBELIA’S CONSENT. THE ARBITRATOR MAY NOT HEAR CLASS OR REPRESENTATIVE CLAIMS OR REQUESTS FOR RELIEF ON BEHALF OF OTHERS. IF A COURT OR ARBITRATOR DECIDES THAT ANY PART OF THIS AGREEMENT TO ARBITRATE CANNOT BE ENFORCED AS TO A PARTICULAR CLAIM OR REMEDY, THEN THAT CLAIM OR REMEDY (AND ONLY THAT CLAIM OR REMEDY) MUST BE BROUGHT IN COURT, AND ALL OTHER CLAIMS MUST BE ARBITRATED.
NOTWITHSTANDING THE ABOVE, YOU AGREE THAT HERBELIA MAY BRING A CLAIM AGAINST YOU IN THE STATE OR FEDERAL COURTS OF WYOMING FOR INJUNCTIVE, EQUITABLE, OR OTHER RELIEF ARISING FROM ANY POTENTIAL OR ACTUAL MISAPPROPRIATION OR INFRINGEMENT OF HERBELIA’S INTELLECTUAL PROPERTY RIGHTS, AND YOU AGREE THAT VENUE IS PROPER AND THAT YOU ARE SUBJECT TO PERSONAL JURISDICTION IN THAT FORUM.
UNLESS YOU TIMELY OPT OUT, YOU WILL NOT HAVE THE RIGHT TO: (A) HAVE A COURT OR JURY DECIDE YOUR DISPUTE; (B) OBTAIN INFORMATION BEFORE THE HEARING TO THE SAME EXTENT AS IN COURT; (C) PARTICIPATE IN A CLASS ACTION IN COURT OR ARBITRATION AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR CLASS OPPONENT; (D) ACT AS A PRIVATE ATTORNEY GENERAL IN COURT OR ARBITRATION; OR (E) JOIN OR CONSOLIDATE YOUR CLAIM WITH THE CLAIM OF ANY OTHER PERSON. OTHER RIGHTS YOU WOULD HAVE IN COURT MAY ALSO BE UNAVAILABLE IN ARBITRATION.
YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF THE DATE YOU PURCHASED A PRODUCT THROUGH THE WEBSITE BY SENDING A LETTER TO: HERBELIA, ATTN: LEGAL DEPARTMENT, 30 N GOULD ST STE R, SHERIDAN, WY 82801, UNITED STATES, STATING YOUR NAME, THE PRODUCT YOU PURCHASED, AND YOUR INTENT TO OPT OUT OF ARBITRATION.
16. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless HERBELIA, its parent, subsidiaries, predecessors, successors, and affiliates, and their respective partners, officers, directors, agents, representatives, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any and all claims, actions, losses, liabilities, damages, expenses, demands, and costs of any kind, including reasonable attorneys’ fees, arising out of or related to (1) your breach of these Terms or the documents they incorporate by reference; (2) your breach of any representation or warranty in this Agreement; or (3) your violation of any law or the rights of a third party.
17. Third-Party Websites and Links
The Website may include materials from third parties or links to third-party websites. We are not liable for any third-party materials or websites, or for any harm or damages related to goods, services, resources, content, or other transactions made in connection with them. Please review each third party’s policies and practices carefully before engaging in any transaction. Complaints, claims, concerns, or questions about third-party products should be directed to that third party.
18. Testimonials, Reviews, and Other Submissions
We’re always glad to hear from our customers and welcome your comments about our products and services. You agree that anything you submit, post, or provide to us — including photographs, testimonials, ideas, questions, reviews, comments, and suggestions (collectively, “Submissions”) — is non-confidential and non-proprietary, and that we have a royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, distribute, display, publish, perform, adapt, and create derivative works from your Submissions by any means and in any form.
You agree that any Submission you provide is true and accurate and does not infringe the intellectual property rights of any third party. You agree that HERBELIA may use a Submission, in whole or in part, together with the name of the person who submitted it, in any form of advertising for HERBELIA products or services, in print and online, at HERBELIA’s discretion. Testimonials reflect individual experiences and do not represent the typical or expected results of every customer.
19. Digital Millennium Copyright Act Notice; Intellectual Property Rights
DMCA Notice. Notices of claimed copyright infringement regarding material posted on the Website should be sent to: support@herbelia.co. We will investigate complaints, and if we believe in good faith that posted material violates applicable law, we will remove or disable access to it and notify the party who posted it.
Under the Digital Millennium Copyright Act, your notice must include: (i) a description of the copyrighted work claimed to be infringed; (ii) a description of the infringing material and enough information for us to locate it; (iii) your contact information, including address, phone number, and/or email address; (iv) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (v) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and (vi) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf. Incomplete notices may delay processing.
Intellectual Property Rights; License. The audio and video materials, images, photographs, articles, text, graphics, illustrations, logos, layouts, designs, interfaces, digital downloads, software, data compilations, and other content on the Website (the “Content”) are owned by or licensed to HERBELIA and are protected by intellectual property, copyright, trademark, trade dress, and other laws in the U.S. and other countries. You must comply with all such laws and any copyright, trademark, or other legal notices or restrictions, and you may not remove or alter them. HERBELIA retains all right, title, and interest in the Website and Content, and no ownership is transferred to you by your access.
You may access and view the Content for personal, non-commercial purposes only, and may not build a business or other enterprise using any of the Content. Except as expressly authorized by us in writing, you may not (directly or through any software, device, website, or service) download, capture, store, archive, or otherwise copy any part of the Website or Content; upload, sell, rent, lease, lend, broadcast, transmit, distribute, display, or perform it; license or sublicense it; or otherwise exploit it. You are also prohibited from modifying the Content, creating or distributing an index of any significant portion of it, or creating derivative works based on it — including mash-ups, montages, translations, themes, fonts, icons, wallpapers, greeting cards, and merchandise — even if you intend to give them away for free.
Copyright. Copyright in all materials on the Website is owned by HERBELIA or its affiliates. Except as stated in these Terms, no material on the Website may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means without HERBELIA’s prior written consent. You may view, print, and download materials for personal, non-commercial, informational use only, provided all copies include this copyright notice. HERBELIA may revoke this permission at any time. You may not mirror any Website material on another server without our written consent. When your rights under these Terms end, you must destroy any downloaded or printed materials obtained from the Website.
Trademarks. The trademarks, service marks, and logos (“Trademarks”) displayed on the Website are registered or unregistered Trademarks of HERBELIA. Nothing on the Website grants, by implication, estoppel, or otherwise, any license or right to use any Trademark without the prior written consent of its owner. The HERBELIA name and Trademarks may not be used in any advertising or publicity without our prior written consent, or as a hyperlink to any website unless approved in advance by HERBELIA in writing.
20. Electronic Communications
You agree that we may communicate with you electronically and that electronic communications, notices, disclosures, and agreements have the same force and effect as if they were in writing and signed by the party sending them.
21. Assignment
You may not assign any of your rights under these Terms, and any attempt to do so is void. HERBELIA and its affiliates may transfer all rights and obligations under these Terms, without further consent or notice, if some or all of HERBELIA’s business is transferred to another entity through merger, sale of assets, or otherwise.
22. No Waiver
No waiver by HERBELIA of any term or condition of these Terms shall be considered a further or continuing waiver of that term or any other. HERBELIA’s failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
23. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
24. Termination
If we terminate this Agreement, Sections 2–5, 12–19, and 21–25, along with any representations, warranties, and other obligations you have made or undertaken, shall survive termination.
25. Entire Agreement
These Terms, together with any policies or operating rules posted by us on the Website, including our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, constitute the entire agreement between you and HERBELIA and supersede any prior or contemporaneous agreements. Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.
